Privacy Statement Stichting Kalpanarts

This Privacy Statement is based on Article 13 of the General Data Protection Regulation and outlines the rights and obligations of Stichting Kalpanarts regarding external individuals whose personal data it processes, primarily in the context of online sales and marketing of theater performances.

Article 1 — General

1.1. The controller for the processing of your personal data is Stichting Kalpanarts.

1.2. Stichting Kalpanarts has drafted this statement in accordance with current Dutch and European legislation on personal data: collection, processing, storage, security, and deletion thereof.

Article 2 — Personal Data

2.1. Personal data you provide us with:

Category 1: Your IP address, with the last four digits anonymized.

Category 2: When subscribing to our newsletter: your email address.

2.2. Stichting Kalpanarts may collect data from you in various ways: During the use of the website, by subscribing to the newsletter.

Article 3 — Purposes of Processing

3.1. General purposes: Stichting Kalpanarts uses collected personal data solely for the following purposes:

Category 1: Maintaining and improving the website and including personal data in anonymous statistics, from which the identity of specific individuals or companies cannot be determined, based on Stichting Kalpanarts' legitimate interests in continuously improving its website and services;

Category 2: Sending you direct marketing, newsletters, promotions, and offers, based on your explicit prior consent;

You are not obliged to provide your personal data, but understand that certain services become impossible when you refuse processing.

3.2. Direct marketing: Personal data will also be used for direct marketing purposes if you have provided additional explicit consent. If you are already included in our mailing list to receive marketing material in paper and/or electronic form, Stichting Kalpanarts may use your data to send marketing and other material related to the company and its performances/programs. This consent can be withdrawn at any time, without justification and free of charge, by clicking on the unsubscribe link in any promotional email.

3.3. Research & analysis: We use your data to continuously improve our services and communication. We analyze the data in our databases for this purpose. The conclusions of these analyses do not contain personal data. We do not analyze individual customers.

3.4. Disclosure to third parties: Stichting Kalpanarts will not sell, rent, distribute, or otherwise commercially make your personal data available to third parties, except as described above or with your prior consent.

3.5. Legal requirements: In rare cases, Stichting Kalpanarts may be required to disclose your personal data pursuant to a court order or to comply with other mandatory laws or regulations. Stichting Kalpanarts will reasonably attempt to inform you in advance thereof, unless this is subject to legal limitations.

Article 4 — Duration of Processing The personal data are stored and processed by us for a period necessary for the purposes of the processing and in function of the contractual relationship between Stichting Kalpanarts and you. Below you will find the retention period for each category of data.

Category 1: These data are stored anonymously and therefore have no expiry date.

Category 2: The data are kept until you unsubscribe from the newsletter.

Article 5 — Your Rights

5.1. Right of access and inspection: You have the right to access your personal data and the use we make of it at any time, free of charge.

5.2. Right of rectification, deletion, and restriction: You are free to disclose or not disclose your personal data to Stichting Kalpanarts. Additionally, you always have the right to request us to rectify, supplement, or delete your personal data. You acknowledge that refusing disclosure or requesting deletion of personal data may render certain services and products unavailable.

5.3. Right to object: You also have the right to object to the processing of your personal data for serious and legitimate reasons. Furthermore, you always have the right to object to the use of personal data for direct marketing purposes; in such cases, you are not required to provide reasons.

5.4. Right to data portability: You have the right to receive your personal data processed by us in a structured, commonly used, and machine-readable format and/or to transfer it to other controllers.

5.5. Right to withdraw consent: To the extent that the processing is based on your prior consent, you have the right to withdraw that consent.

5.6. Exercise of your rights: You can exercise your rights by contacting us by email. It must be demonstrable that you are the person in question.

5.7. Automated decisions and profiling: The processing of your personal data does not involve profiling, nor will you be subject to automated decisions by us.

Article 6 — Security and Confidentiality

6.1. We have developed security measures adapted to technical and organizational aspects to prevent the destruction, loss, falsification, alteration, unauthorized access, or accidental disclosure to third parties of collected personal data, as well as any other unauthorized processing of this data.

6.2. In no event shall Stichting Kalpanarts be liable for any direct or indirect damages resulting from the incorrect or unlawful use of personal data by a third party.

6.3. You must always comply with security regulations, including preventing any unauthorized access to your login and code. You are solely responsible for the use made from the website of your computer, IP address, and your identification data and their confidentiality.

Article 7 — Access by Third Parties

7.1. In order to process your personal data, we grant access to your personal data to our employees. Only employees who require access to perform their duties within Stichting Kalpanarts may access your data.

7.2. We share your data with several processors, which are other organizations that work for us. They provide us, for example, with software to store, secure, analyze your data, and help us provide you with the services you request from us, such as buying tickets.

7.3. Our processors and sub-processors are as follows: Mailchimp for storing personal data and sending newsletters, press releases, and invitations. Google Analytics: For insight into website visits.

7.4. Through contractual obligations with our employees and internal policies, we ensure a secure handling of your personal data by our employees, in accordance with privacy legislation and this statement.
